The law is valid until it is changed so penalties will still be incurred until the law is changed.
But Republicans could decide not to enforce the penalties, though you will not know that for sure until they actually do it, if they do.
IMO it is best not to second guess it all, and follow the law as it now is.

Considering even Congress has no clue, how should we?
A little clarity on pre-existing. (PEC) ANY condition you are diagnosed with when you are uninsured is a PEC. What that typically means is if you get insurance they won't cover that one ailment for 6-12 months, although it could be much longer.
Let's say you have BC/BS for a couple years. You get fired and lose your insurance. If you get new insurance within 60 days, you have no PEC bc that's not a gap in coverage. If you get a new dx during that 60 days then that condition is a PEC. If you have to wait 90 days, then everything you have is a PEC.- Quote
