Do all doctors have malpractice insurance?

    Do all doctors have malpractice insurance?

    Are all doctors required by law to have malpractice insurance?
    What happens if they do not have effective insurance at the time of an accident or a mistake?
    It s not 100% clear right now in our situation but it seems the doctor may NOT have effective insurance.

    I don't think so. You can check the medical licensing board of your state.

    What happens if they do not have effective insurance at the time of an accident or a mistake?
    An uninsured malpractice judgment would probably drive them out of the medical business and into bankruptcy.

    It s not 100% clear right now in our situation but it seems the doctor may NOT have effective insurance.
    Then you go after his personal fortune if and when you get a judgment.

      Legally it is not compulsory for doctors to have malpractice insurance. If the doctor is aware of the risks of not having a malpractice insurance, he certainly was covered.

        Most states required doctors to have a minimum amount of insurance. If they do not, many states have a fund to which you can go to seek recovery for your damage. Also, it is sometimes possible to go after the medical facility where the event took place. Your answer would really depend on your specific jurisdiction.

          I have never hears of a doctor that practices without such insurance.
          Does such a situation even exist in the US?

            Yes, it does.

            Lots of people and businesses don't buy insurance, sometimes even when it's illegal not to have it - like car liability insurance which is mandatory in almost every US state.

              I think in the USA it would be next to impossible given the amount of litigation there.

                Sometimes it is more a matter of being between companies that causes it.
                Due to a recent promotion, I should now be referred to as Major Obvious.

                I would not be trying to provide information and knowledge if I did not sympathize.

                Some days it is just not worth chewing through the restraints to face life.
