Default Can I sue doctor for lying about recovery time?

Hi. I recently got a hernia surgery. Before surgery, dr said I'll be fully recovered in 2 weeks. After surgery he said I would feel the pain for 4-6 weeks. Also, he wouldn't perscribed painkillers after the first two weeks, telling me to take advil, return to full activity, and to not be a chicken. After painkillers stopped, I noticed sharp nerve pains shooting in my abs and pelvis, ranging from mild to SEVERE. I even went to the ER because of it. The dr claimed it has nothing to do with his surgery and told me to see my physician and he couldn't help me further.

Can I sue for lying about recovery time, telling me deal with the pain and suck it up and not giving me painkillers for long enough, and for not helping address the pain?

I told him advil and motrin weren't helping. The pain is still there and the urologist I saw said I have to go back to my surgeon to deal with the pain. I am still in a lot of pain and haven't been able to go to office or travel... Its really wrong!

I wish to inform you that you may file a suit for negligence or malpractice. In this regard you may argue that doctor knew time required for healing and it was material fact in your consenting for taking medical treatment. You may present expert evidence of doctor to show negligence in medical treatment.

Seriously?

There's no way any doctor can predict how long any one person will take to recover from surgery. There is no lawsuit here.

He did address the pain, switching you from prescription pain medications to OTC products. Physicians are hesitant to prescribe prescription pain meds due to the risk of addiction and overuse by some folks.

Everyone heals differently depending on their body and individual circumstances. Being an anomaly is not a reason to sue for malpractice.

If a pain problem persists, is it within reason to get a second opinion from another Doctor?
My doctor can't legally stop that can he, or dismiss me because I did it?

You can certainly obtain a second opinion. Your doctor can elect to drop you as a patient at any time.

If I get a second opinion must the doctor put in writing what he told me at the appointment?

It was very negative as to the first doctor's work.

No not really.

Outside of court proceedings, there is no law that requires that.
And in fact many doctors do NOT like to openly criticize other doctors.

Medicine is referred to as a practice. That is because of the uncertainty factor in part.
