You have not provided proof the rock was not simply picked up off the road as debris and was a result of the trucking companies operation of the truck. They are not responsible for a road hazard as long as the truck had appropriate mud flaps on it. This can really suck for people following a bobtail as rocks can fly straight up, over the mud flaps and hit your windshield. That still does not make it the trucking companies fault. So basically, unless you can testify beyond a reasonable doubt the truck did not have a mudflap, you are on your own for the damage. It is no different than the paint peppering on the front of vehicles. Usually your own insurance will cover it if you have full coverage.

Hard to prove it was the truck I agree but many trucking companies will not argue the point and let their insurer pay.
