Default Any limit on the number of small claims cases you can file?

Hi:

In the US in New York can one use small claims court several times in the year or is there a limit on how many cases you can file?

If e.g. by odd coincidence one has 5 cases that year, is that a problem?

You can file in Small Claims Court if the amount asking is $5000 or below. You cannot file more than 5 claims in a month.

The fact you are a serial filer can be used to your detriment eventually if it becomes clear you are wasting the courts time.

I think also some limits are placed to avoid debt collectors are others that are using the small claims court in a repetitive fashion for their business as well.

Yes, and no.

That is the limit in city courts.

Town and Village Justice Courts have a limit of $3000.

Why DO they limit it to five cases per month?
Is that to stop small businesses from using it too much and if so why is that even a policy?

They don't want debt collectors clogging the court for one reason!

is it limited to 5 or some other similar number?

It seems to me there should not be a limit on the number of cases an individuals.

I don't know why they allow that. Some years there just may be a lot of things going on.
