Default Can I cap my claim at 5000 dollars in small claims court

If I have a claim for 6000 dollars owed, but the maximum in small claims court is 5000 dollars, can I agree to cap my claim at 5000 and forfeit the 1000 in order to be in small claims court?

Yes.

In fact, you automatically waive the excess amount as soon as you file for the $5000.
