Default images of a company now out of business

When a small company goes out of business and is not using any of its images or logos, can I use one that is based on their old image and is almost the same? Is there any legal problem with that?

I wish to inform you that you may use images of logo which are now not in use. If business is closed and all persons dealing with that business know that business has been closed then you may use images because no other party is using those images nor it may deceive any customer. As per decision in the case of Cumulus Media, Inc. v. Clear Channel Communs, Inc., 304 F.3.d 1167, 1173 trade mark is free to be used after business has been closed. If image has been under trademark with USPTO then you may check status of trademark before use and may use image only if status shows that trademark is not live.

Somebody could have received or purchased the images and IP as part of the shut down. So make sure nobody is currently holding the intellectual property even if the business is not in operation now.

Legally it is not possible to use a company’s images or logos for the reason that the company is inactive. The person who intends to use the company’s images and logo must seek written permission from the authorized persons of the company.
