Default verbal agreement with a mechanic

Georgia

I made an initial verbal agreement with a mechanic to have services done on my vehicle. The amount to repair the car, labor and parts, was $1500. I've paid him $1000 upfront and agreed to pay the rest later. Now that the car is ready, he is claiming that we agreed to $1500 labor and $1000 parts, $1000 over what I thought was the total. He currently has the car and I don't know if I will get it back with the repairs.

Is this some fly-by-night guy who works out of his back yard? Reputable auto repair businesses give you written estimates and don't take money up front.

Go to his business and look at your car and see if he's done anything to it.

I think the poster means the repair person may try to hold it until poster pays all that the repair man demands.

Poster already said that the repair man said the repairs are done

The repair guy may have to sued in small claims and/or file a complaint with the State Attorney Generals's office.
Those steps might cause a compromise.

Even though a verbal agreement is legally binding, it is difficult to enforce it in a court of law. If you have a witness to the verbal agreement, you can call the witness to memorialize the terms agreed upon. If the case comes before a court of law the court will look whether the current repair cost exceeds the amount what you agreed upon and the decision will be based on the actual cost incurred. Further you have the right to get back your car repaired and you are obliged to pay the actual cost.

I agree with this comment.
If you are sure he is lying, report him to the state attorney general's office--or threaten to do so and that may resolve it.
