Default Can I form a US tax exempt nonprofit as a foreigner

Am I allowed to start a nonprofit entity, tax exempt in the USA if I do not live in the USA?

I live now in the UAE and I am a British citizen. I do go the US twice a year on other business.

Some people seem to suggest it is ok to do but it is never really clear.

Unless you have the proper visa, you cannot do any type of business activity in the US.

Oh that is not true.

You can do business in the US and live and be outside the US

That just is not correct.

You can e,g. clearly form a company and do whatever you wish.

You can incorporate from outside the country, you cannot violate the terms of a visa, such as coming here to form a corporation.

You can form an organization yes.

And you can run it. But you will be subject to all US rules and tax exempt organizations are heavily scrutinized as you may know.

But a number of international aid groups and international nonprofits do great things and yours may too.

In this regard you need to find a sponsor so that you can smoothly function your nonprofit entity in US. Further you need to consult an attorney to make the procedures smooth.

That is true, I just did it,

But somebody (an officer, lawyer etc) in the US likely has to be there for the banking issues these days.
The banks won't just open any and all accounts for foreigners or for firms owned by foreigners.
