Default Can Amazon.com legally close my account for too many returns?

Can Amazon legally close my account for too many returns?
Can I prevail if I challenge them in court?
Their policy says they will accept all returns so how have I violated their agreement?
I have only returned 7 items in the last year. That does not seem extreme to me. And I purchased over 40 items.

In this case they will never admit that they closed the account for your repeated returns. They will figure out some other reasons that you could not dispute.

Presumably you understand that by USING Amazon services you agree to Amazon's Conditions of Use.

There's a couple of interesting provisions in there:

"When you use an Amazon Service (for example, Your Profile, Gift Cards, Amazon Video, Your Media Library, Amazon devices, or Amazon applications) you also will be subject to the guidelines, terms and agreements applicable to that Amazon Service ("Service Terms"). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control."

To me that means yes, they accept all returns but the Conditions of Use trump the fact that they accepted your returns.

Another provision:

"You may not misuse the Amazon Services."

"Misuse" is in the eye of the beholder. Is 9 returns in a year out of 40 purchases "misuse"? I don't know. Personally I don't think so.

But the important question is how much money are you willing to spend on lawyer fees to go up against Amazon's lawyers to answer a very nebulous question.

Your "contract" with Amazon requires that all disputes go to binding arbitration so you can't challenge Amazon "in court." It has to be through binding arbitration as outlined in the Conditions of Use.

My conclusion is that Amazon did "legally" close your account if Amazon decided that you "misused" the services.

If you want to dispute that, then follow the instructions for arbitration and give it a go.

No way to predict the outcome.

Amazon like most merchants can close any account they deem suspicious or problematic.

Your bank can do the same thing. EBay too. Etc. It happens every day.

Nothing except that "terms of service appear to have been violated" .

I guess one can supposedly appeal it but who has the time for all of that?

Appeal? A company doesn't have to do business with you if they choose not to. Move on with your life.

Just about anything you can buy on Amazon can be had other places.

That's right.

I find the same vendors on Amazon selling on eBay at better prices with free shipping (with no gimmicks) and eBay has a guarantee for buyer satisfaction.

I had only TWO returns and they closed my account. They said the account had suspicious behavior but never detailed what that behavior was.
These monopolies can get away with anything these days.
