Post Online transfer from my brother, can he claim ?

Hi all,

I have received an amount online from my real brother on account of some property sell of my father and the same is non refundable as per mutual understanding of my father, mother etc. Is my brother able to claim for that amount after some time i.e. months or years? Also please tell me that what basic formalities i have to keep in this regard ?

I wish to inform you that if transfer of amount is in the form of gift then you are not liable to return this amount. You may make a written agreement that said amount is out of love and affection in the form of gift thus said amount need not be returned. As amount if being paid by your parents thus their action may be regarded as gift.

If your brother has no written agreement and no express terms of repayment, it will be assumed to be a gift, unless he can prove otherwise.

You are required to keep records of the property transactions, so that you can show that the amount you received from your brother is part of your share in the transaction. Otherwise your brother can demand the amount by stating it as a credit.

He cannot legitimately claim any such amount if the original purpose was a gift or other arrangement that you all made within the family.
Hopefully you have some proof of why you did indeed receive those funds.
That proof is all you need.
And of course you could also testify if your brother really pursued the issue, but some additional proof would be helpful.
