    New York unemployment after four months?

    Is a person that is fired "for cause" - so they say - eligible for unemployment in New York if the person worked full time for four months and about six Sundays with overtime.

    It's long story but my girlfriend was just fired yesterday and needs to know if there is anything she can do now.

    In this case she is eligible for unemployment if she can prove that she has sufficient period of employment to establish a claim and lost the job for not her fault and she is willing and able to work and is actively seeking for a job.

      "For cause" is meaningless when it comes to unemployment compensation. Everybody gets fired for some "cause" or other.

      What counts is "misconduct" as defined by the state eligibility laws.

      If the employer can prove "misconduct" she will not likely be eligible for unemployment compensation.

      She should file for it ASAP anyway and let the state make the determination.
