Default I am due to give birth on my trial date.

I am due to give birth on my trial date.
Is that in and of itself reason to change the trial date?

The date is 4 months approximately from today, if that matters at all.

Trial is for theft of an item worth 100 dollars.

Probably.

But you aren't going to get a postponement this far in advance because your guess-timated due date can be off at least a week on either side.

What you might do, however, is ask the court to have the trial sooner, maybe two or three months from now.

That could even work to your advantage. You might get some sympathy when you waddle in big and fat. Might get you some sort of deferred adjudication where it gets dismissed if you behave for a probationary period.

I wish to inform you that you may file a motion for change of trial date. You may exhibit a medical certificate from your doctor to support your request. The Court will consider all the facts and decide the matter. You may contact your attorney and seek further guidance in the matter.

If you are sure that you could not attend the trial due to your situation it is good to advance the trial date than to postpone the case. In this regard you can move a motion to advance the case showing the reason.

If your water breaks in court, they will reschedule. Otherwise only if the doctor has written you on bed rest 24/7.

The PD here often wont even meet with you till the few days before the trial. They're too busy it seems.
But the judge did move it thankfully.
