If I asked what can $100 get me to an escort via a text, and she responds with a price but I never responded, is that solicitation of an escort/prostitute? And could I be arrested?

re: Solicitation of an escort/prostitute
I wish to inform you that you may have the burden to show that you were not soliciting. As there is a text message thus it may be alleged that you were trying to solicit a prostitute. In this you may argue that you never had the intention and this may be seen that you never replied to price message. You may argue that you only had communication with no intention of solicitation.

Re: Solicitation of an escort/prostitute
I have another question for you to, because this was a careless night drinking with friends and we never had intentions of anything but just simply texted a few out of curiosity. Another message asked hourly rates and looking to do business?
If they did respond with a price, I never responded to any of them and immediately deleted the messages. Do you think I should be expecting to hear from police any time soon? Even though I never responded and never inquired about sexual acts in any form, do they have a case to come after me if one was police?- Quote

OMG, at least have the sense to travel to a place prostitution is legal.Due to a recent promotion, I should now be referred to as Major Obvious.
I would not be trying to provide information and knowledge if I did not sympathize.
Some days it is just not worth chewing through the restraints to face life.- Quote

For all anyone knows you could have been doing an academic study of the going rate for such services in that community.- Quote

Probably not. The police do this in sting operations all the time. Only if and when one shows up clearly demonstrating their intent to use the 'services' can the police arrest.

Re: Solicitation of an escort/prostitute
If you are soliciting into another state then you are not protected by NV laws,
And even in NV, prostitution is regulated such that your texts may still not be protected if not part of a licensed and legal operation.
I would advise avoiding such text activity on your phone--completely.- Quote

Furthermore such behavior across state lines may carry heavier federal penalties.- Quote

Re: Solicitation of an escort/prostitute
Any solicitation of sex for money technically qualifies. Of course a prosecutor has to be able to prove to a jury that a crime was committed, and intent to commit a crime existed.
But you do not want to be close to the line on any such issue. So avoid that kind of conduct. And don't assume you found some kind of loophole.
That would be most lawyers' advice IMO.- Quote
