    Wet floor sign and liability

    The Wendy's store where I fell and broke my ankle bone had a sign on the floor saying wet floor.
    Does that mean they are not liable and cannot be sued?

    It means that they are "probably" not liable but anybody can sue anybody for anything.

    What, if any, discussions have you had with the owner since the accident? With what result?

      I wish to inform you that the laws of your State will have jurisdiction in the matter. Further, the Plaintiff in a slip and fall case is required to prove that the Defendant was negligent. Negligence means that the Defendant was not reasonable under the circumstances. You may contact an attorney and seek guidance.

        In this regard you should check whether sign is visible to all who is passing by or it is kept in a negligent way. Further, if the store is a rented one and the cleaning is done by the property management the claim should be against them and you can place the store as second defendant. If the cleaning is done by the store you can make your claim against the store only. In this case if you can prove that the property management/store is negligent in placing wet floor signs and that results the injury, you can raise a valid claim against them.

          It somewhat reduces a possible finding of fault but it does NOT stop a lawsuit.

          If a PI lawyer will take the case then go ahead. If no lawyer will take it on contingency then unfortunately you probably have no real chance of winning any damages. Let the professionals assess the situation.

                    As a matter of fairness - if you chose to ignore the sign then it's on YOU.

                    So if no one pays attention to speed limit or traffic control signs that means no one should ever get a traffic ticket? Yeah right.

                            The sign provides notice. If you don't see the very noticeable plastic warning thing in the middle of the floor maybe you need to see an ophthalmologist.
