    Basically, no. But there are alternatives allowed and there are some exceptions.

      If the doctor has no malpractice insurance do victims just sue the doctor in his own name then? What if he has no money?

      Does New York require medical malpractice insurance?

      I am considering a claim to file.

        You have no one else to sue BUT the doctor "in his own name".

        Based on your apparent lack of knowledge, I suggest you consult with a licensed NY attorney.
