Default ex-wife's lawyer is trying to get my employment records

Ohio

I am the girlfriend to a man going through a divorce. We drive semi together and the soon to be ex-wife's lawyer is trying to get my employment records without my permission. What are my rights? Am I not protected by the Privacy Act of 1974 or some other law?

In the case of El Dorado Savings & Loan v. Superior Court court held rights of privacy. You may also seek privacy rights on the ground that your employment record is not subject matter of dispute. While the case is with the soon to be ex wife and hence your employment record is not involved in litigation and your employer may breach your privacy if he provides information in absence of court ordering him to provide such information.

If the lawyer has issued a subpoena you may need to file a motion to quash the subpoena and object that the information is not relevant to the case.

You can see the format or forms on many legal forms sites--if you do not have counsel.

You are protected by the Privacy Act and you can inform your employer that you are not involved in a case and if the employer provides the employment record to a third party will amount to a breach of privacy policy.

Her going to be Ex-wife lawyer cannot do that. it is breaching of your privacy and you can definitely sue her lawyer for breaching your employment records.
Lawyers can subpoena the contents of the personnel records for lawsuits but in your case, you can object that it is not relevant to this case.
