Default Grounds to invalidate this judge?

In our contested divorce, the judge "says" he is likely going to divide custody of our two kids 50/50 between me and my wife, but my wife failed a cocaine test and has been using it regularly. The judge knows about the test results.


Is this grounds to invalidate this judge or file some emergency appeal or what can I do? Neither of us has an attorney.

There is nothing you can do until the judge makes his decision and enters it into the record.

If you think this isn't going your way, you'd better hire a lawyer.

Did you file the cocaine test result with the court together with evidence that your wife is regularly using cocaine?. If No, you should properly file the test results with the court in order to consider by the judge.

I wish to inform you that in the matters of a child, the Court always keeps the best interest of the child in view and generally wants the child to grow up under the love and care of both the parents. The burden of proof is on you to show that the mother is unfit to be a mother who has failed the cocaine test and for other good cause. The Court will consider all the facts and decide the matter. You may contact an attorney and seek guidance.

Judges do not get "invalidated", whatever that really means.

What does your attorney have to say about this? If you do not have an attorney then you need to get one.

You can certainly appeal the judgment, but the appeal will on issues raised at trial and the courts response. I don't like it does not constitute grounds. You should have hired a lawyer or asked for a guardian ad litem to have been appointed to determine the children's best interests.
