Default 21 year old with a previous DUI and new charge

New York

21 year old with a previous DUI,was just recently arrested for avoiding being pulled over and having drugs in his car. How long is the minimum or maximum time he is looking at for jail time?

The defendant's lawyer is the one to ask. But if you want guesses from strangers on the internet you'll have to tell us what statute numbers he's being charged with and when the DUI conviction was and whether he was still on probation for the DUI conviction.

I agree with the above AND it depends what drug etc.
But the fleeing the officer part is going to make things worse unfortunately.
A person in that situation must have an attorney ASAP.

It's DWI in NY.

Is it YOU who is in trouble? There is a really good chance that this person will not be driving for a long time, in addition to the other criminal issues.

It makes no difference when the previous DWI was since that doesn't appear to be related to the current charges. Probation for a first time offender is doubtful.

For all we know the defendant was also driving with a revoked license from the earlier DWI.

In this type cases sentencing was depended on the amount of drugs found in possession and the previous history of similar type of crime.
