Default Husband's drug charge and visa to the USA

My Husband was arrested in France 6 years ago and found guilty of drugs possession.
He served 90 days in jail.

I am French as is he.

I have now been transferred to the USA for my job.
Is he able to go with me to the USA?

I wish to inform you that grounds of inadmissibility listed in Section 212(a) of the Immigration and Nationality Act (I.N.A.) includes conviction or admission of a controlled substance violation, whether under U.S. or foreign law. You may consult with an experienced immigration attorney and seek guidance.

I don't think the odds of entry are good unfortunately.

Apply for a visa in advance and IF you get the visa then there is a fairly good chance that the Border Control will let him proceed. But even that unfortunately is not guaranteed so it all is a bit of a hassle.

It is good to consult an immigration lawyer regarding the issue in detail, so that he/she can advise you how to proceed with current visa process.

The employer is going to see if they can help us to get a lawyer and work on this matter. I will let you know how it goes.

Politics plays no part. Enforcement of Federal Law does. It requires a waiver by the Federal gov't, who are asked for waivers for criminals all the time.
