I am an ofw here in Dubai living together with my brother who was seperated to to his wife for more than 8 years.

Pareho na silang may sariling pamilya but they have 2kids( 1st year high school and grade 5). Nasa hipag ko ang mga bata. Before umalis ang kapatid ko para mag ibang bansa nagkaroon silang agreement s harap ng abogado na need ng kapatid q magsupport financially sa 2 ko pamangkin ng tig 1k. Lately nagdemand ang ang hipag ko na kailangan nia ng mas malaki support dahil maghihigh school na at gusto n sa private school ipasok yung panganay nila which is di naman kayang isupport ng kapatid q dahil sa may 4 pa ciang anak n kailangan din nia suportahan sa present niang kinakasama. To tell you honestly di naman kalakihan ang kita ng kapatid ko dito,merchandiser po ang trabaho nia sa supermarket at ang laki din ng expenses dito. Ngaun po nakareceived ang nanay q ng subpoena na nagdedemand na magbigay ng 10k n support ang kapatid q sa anak nila.

Wala naman ako kinakampihan sa kanila dahil ang concern ko ay ang mga pamangkin ko. Pero sa estado ng trabaho ng kapatid ko alam ko na di talaga nia kaya ibigay ang 10k monthly. Samantalang ang hipag ko po ay may mas magandang trabaho sa call center, maayos n bahay, at maalwan ang pamumuhay kasama ng kanyang kinakasama. Di naman po lahat ng nasa ibang bansa ay kumikita ng malaki lalo na dito sa Dubai. Wala na nga po halos natitira sa amin para lng mapadala sa pinas.

Ano po ba ang pwedeng laban ng kapatid ko sa ganitong sitwasyon?

Hi, would just like to ask because my younger brother has been asking advice.

He and his legal wife are planning to separate and he needs to provide support. They have 2 kids. But his wife said that what he earns now will not be enough to support them, in fact, magkukulang pa daw. Is it legal or possible that the mother will demand an amount more than his earnings? Even if the wife takes 80% of his salary, I think that it is more than enough to cover their necessities. But the wife says otherwise. He has no problem giving that amount (70-80% of his earnings) but I think it is a bit too much. How can he pay for his own needs if all of his salary (which is kulang pa daw) goes to her? If it helps, his salary is 40k/month.

Just wanted to ask if it is legal for the wife to demand that way.
