Share ko lang experience ko sa credit card delinquency,

Way back 2012 nagkaroon ako ng kauna-unahan kong credit card yung AmEx (Amercan Express) Dala ng excitement at first time magkaroon nito naging defaulter din ako at di ko na nabayaran.

Umabot ng almost 200K ang utang ko kasama na ang patong-patong na charges at penalties nila (105K lang naman ang credit limit ko). Mabuti na lang hindi masyado makulit si AmEx kagaya ng mga nababasa ko dito at hindi rin ako naka-received ng any form of harassment sa mga collection agency na pinasahan nila.

Akala ko noon habangbuhay na ako mabubuhay sa cash. Kasi kahit ano bank applyan ko ng credit card lagi ako rejected. Pati yung kotse na kinuha ko sa mama ko naka-pangalan kasi di rin ako na-approved sa loan.

Hanggang nung 2016 nagulat ako kasi na-approved yung cc application ko sa RCBC Bankcard. Totoo pala na nawawala rin ang pagiging blacklisted mo sa cc delinquency. Sunod-sunod na ulit ako na-approved sa cc application. Sa ngaun eto na nag issue sakin ulit ng credit cards:

2 RCBC Bankcard
2 Citibank
2 BPI
1 Security Bank
1 Metrobank

Sa ngaun mas maingat na ako sa panggamit nito at nagbabayad na ako ng maayos. Sana nakatulong story ko.

Did you apply with BPI to get a credit card? If yes, then read Supreme Court jurisprudence GR 175490. Better if you still have with you your copies of your statements of account. Review the re-computation made by the Supreme Court in the latter part of the decision and applied it to your account using your statements.

The bank's interest and penalty charges are eating your payments that is why your outstanding balance remains the same. Do not make payments without any signed agreement. You are wasting your hard earned money.

If the cc was given to you freely, then Ledda case (GR200868) is applicable to you. Using your statements of account, recompute your cc at 1% only.

Review both Supreme Court rulings and determine which one is applicable in your case. I hope you keep your monthly statements of account because it will be a big help in recomputing your outstanding balance. The bank may not provide it to you.

Hi po, please enlighten me.
I have credit cards with RCBC and Citibank. Since last year Ive been sttuggling to pay them kasi nagkasunod sunod problema ko financially and health wise too. Wala na rin akong work. Now Im here in the US married to a US citizen. Since I got here nagbabayad pa rin ako kahit ung minimum lang unfortunately, di na talaga kaya and ayokong isali ang asawa ko sa problema ko kasi marami ring bayarin d2. I owe them 200k kaya natatakot ako sa consequences. Nasa Manila pa family ko and sinabihan ko na sila abt it. I know na pde akong mkasuhan ng criminal case at civil case. Gusto kong bayaran pero wala pa akong trabaho d2. Buntis din ako at the moment kaya matatagalan bago ako makawork. Mahahabol po ba nila ako when they file a case lalo kung criminal case xa kahit andito na ako sa US? Im stressed right now sa kakaisip on what to do. I hope someone can enlighten me po..thanks.

Hi Mrs X,

I've seen a lot of people in same situation as you, hindi ka nag iisa, alam credit card collecting agency cannot force you to pay by intimidating mas lalo di magbabayad ang tao nya sa pananakot. please remain calm when you received a demand letter from them.

I'm not saying na di mo sya bayaran, but since your paying just below the minimum that means you have the willingness to pay and I admire you for that.

the best way is to settle it with the collecting agency, tell them honestly that you cannot pay and you may bargain it by paying in installment. they dont have a choice otherwise wala silang ma collect sa yo.

but, they cannot intimidate you to pay this is not the right way to collect debt.

personally i've been to your situation but, thanks i was able to get out of it. naghanap ako ng paraan para mabayaran. but , i did negotiate with the collecting agency.

I have the same problem as you. The bank is BPI and it is also 40k above. They also let me pay for the transaction. I am not paying it. They told me they transfered my account to a law firm. I am also stressed out. Hope someone can help us.

How would I know if the I did not apply for the credit card, because I can't remember. I mean how will I prove the bank that I did not apply for the credit card? Thanks

Hi, may utang po ako sa cc ko na 75k according sa latest SOA ko then may dumating po na letter saken from law office na 100k daw yung utang ko, probably collecting agency na sila. My question is, pwede po bang bayadan ko nalang yun 75k sa bank without communicating sa agency? Macclear na po ba ko nun? Thanks po

good day new cc defaukter member here po.... kanina nakatanggap ako ng Summon BDO SOM civil case filed against me by a collecting agency kailangan ko umappear at magfile ng sagot.. paano ba mayos na gawin dito nirerecieve ko naman lahat ng demand letter na para malaman na hindi ko tatakbuhan sila... help naman po paano ko ito masagot ng maayos.. thank you..
