Default Can I be sued as a co-signor?

Can I be sued as a co-signor on a car lease in the event of a car accident?

Anybody can sue anybody for anything so the answer is yes, but likely not successfully as just being a guarantor on a loan doesn't make you liable for the operation of the vehicle.

Understand that, if you are sued, the cost of defense could eat you alive so make sure you are named as additional insured for the liability coverage on the car owner's policy.

Are you a guarantor of the lease or a co-lessee?

If you are one of two lessees then yes you could be liable but hopefully you would have insurance then.

Co-signing is dangerous and puts you at risk. There is no distinction between owning and leasing; you can be sued for accidents involving the leased car, as long as the driver of the car was: a) permitted to drive (didn't steal it, etc.), and b) was at fault. If someone is seriously injured or killed in the car crash, you could be sued for a very great deal of money.

In this matter you will not be held liable for the accident. Only the driver of the car is liable for the accident.

Wrong as usual.

While it is true that the driver is responsible for his negligence, the owner can also be liable.

In some states (NY for example) it's a statutory liability but there is also the doctrine of Negligent Entrustment that could make an owner or co-lessee liable.

Well you should check that carefully to be sure.

If you are a co-lessee then you are the lessee as well and do have responsibility.
But your insurer should help you handle that.
