Default Insurance damages and small claims court too?

If my insurance pays me for the damages to my car, can I still sue the person that hit my car--i.e. sue iin small claims court?

I had items in the car that were damaged that insurance will not pay for so I want to sue in small claims court.

Yes, for the separate personal property loss, you can sue in small claims court.

Understand, though, that you would only be entitled to the used value of those items. Depreciation would have to be applied based on the age of the items.

Why haven't you approached the other driver's insurance company about getting paid for those items?

Might avoid the cost and inconvenience of filing a lawsuit.

Note that the cost of filing in small claims is very small.
Usually not much of an issue at all.

But the inconvenience and possible stress of such proceedings certainly may be a consideration.

Yes of course you can sue the person who hit you in low court with a small amount of money to pay it. However you can do only that if he/she doesn't pay you after the incident, then you will meet at the court. Which insurance got you?

Highwayman, I know it's not in the Philippines. Did I state the country issues? Of course not. I just knew some reliable & trusted insurance company that helps different countries to maximize their insurance, that's why I was asking to Dandy which insurance company covers him?

You can't collect twice for the same thing but if some damages are not covered by insurance and the law allows you to seek civil damages then you certainly can file suit even after collecting insurance on part of the damages.
