Default Nursing home surgery and death

My mother was in a nursing home. Unaware the facility doctor had brought in a third party doctor/contract to perform procedure's for bed sores, foot wound. The third party doctor examined my mother left a consent form for me to sign. The facility never advised me of the form. Several days later the procedure was done and the consent form was never signed as I did not have knowledge of it. My mother passed away the following day.

The third party doctor has ignored my request for a copy of the consent form signed. This week I sent a certified letter requesting the form and the medical notes on the precedure performed and follow up care.
The nursing home has refused to release further medical records because Of a HIPPA law that protects them.

There attorney sent me a letter thru them requesting I obtain probate to be appointed her representive. My mother left no will or estate. I feel like I am getting the run around! Not sure what to do next.

I wish to inform you that representative of estate has legal authority to file lawsuit seeking compensation for death caused by negligence. You may act as legal executor of the estate through court order while transferring all assets of your mother to the names of legal heir and can file a lawsuit against hospital and physician for medical negligence and can seek compensation. At start of probate proceedings you can have court order regarding legal executor or administrator of estate.

Has she been declared mentally incompetent? If not your signature was not needed. Few people die from treatment of bed sores on the feet. It sounds like they brought in a podiatrist.

It sounds like she was already in a bad way.

You can of course contact a lawyer, if he concerned about the bed sores. They should've been turning her every two hours.

It helped to motivate me to deal with this.
I have resolved the issue and I have much more information about the events now.
A reasonable settlement is also being reached.
