    Two insurers at the same time and one claim.

    I have two insurance policies that overlapped by about three weeks and a claim now exists for flooding of my apartment, and persian rug damage, done by the neighbor above.
    How does that work now, who actually pays and covers it?
    Can I just use the old insurer and not the new one?
    Florida.

    No. Report to both. They will co-ordinate and each will pay a pro-rated share of the loss.

    The following is a standard provision of a homeowners or renters policy:

    Other Insurance
    If a loss covered by this policy is also covered by:
    Other insurance, we will pay only the proportion of the loss that the limit of liability that applies under this policy bears to the total amount of insurance covering the loss
    Never try to hide something from an insurance company.

      Ditto, report it to both and let them coordinate benefits.

      I would not be trying to provide information and knowledge if I did not sympathize.

      Some days it is just not worth chewing through the restraints to face life.

        If you have two insurance you can apply to both if one insurance solely cover the damages, but if damages are covered by one insurance, you can use only one.

          I think ALL polices require you to inform both insurers if you have two that possibly apply.

            Can I just choose which one I want to handle it?
            Or is that not permitted.
            I have 2 auto policies that both cover my accident last week. They were accidentally overlapping by a month.

              The contractual provisions of an auto policy are similar to those of a homeowners policy.

              You must report the claim to both insurance companies and allow coordination between the two.

              If you conceal the existence of one of the policies you could end up with no coverage and no insurance due to the fraud provision of the policy.

                The basic principal is that, if you have two insurance policies your damage will be covered by both the insurance in their proportionate share.

                  There may be an exception to that if the old policy has an automatic termination provision.

                  Look for:

                  Automatic Termination
                  1. If you obtain other insurance on your covered auto, any similar insurance provided by this policy will terminate as to that auto on the effective date of the other insurance.

                            I don't see any where in my Geico policy where it talks about a a second insurer.
                            Maybe I am missing it.
                            I will call them.

                              You are. There are standard provisions in every auto policy no matter what company.

                              Take out the policy booklet.

                              At the end of the liability section it should have something like this:

                              OTHER INSURANCE
                              If there is other applicable liability insurance we will
                              pay only our share of the loss. Our share is the
                              proportion that our limit of liability bears to the total
                              of all applicable limits.


                              The same paragraph should also be at the end of the Medical Payments section.

                              In fact, provisions about Other Insurance appear 4 or 5 times in the policy booklet and are pretty hard to miss.
