Default Rings after I broke off the engagement

Pennsylvania

I live in Pennsylvania. I was in a relationship for four years and engaged for a year and a half. I broke off the engagement because he was unfaithful. I asked him upon split if he wanted the rings back and he told me no I could keep them along with a necklace he gave me. Now a couple weeks have pasted and he is demanding on having them returned and threatening to take sue me over it. What is right here? What rights do I have?

I wish to inform you that you may keep ring and chain with yourself. As other party has provided you ring and chain as gift thus you have become owner of chain and ring and now other party cannot demand back. You may inform other party that as you have been provided these items as gift thus these items may not be now demanded by other party.

Wrong, Affa.

The PA Supreme Court decided just the opposite in 1999.

See:

Lindh v. Surman, 742 A.2d 643 (Pa. 1999)

http://caselaw.findlaw.com/pa-suprem...t/1131972.html

Here's a summary of the case:

The rule in PA--and it varies in each state--is that the ring goes back to the giver if the parties do not marry,

BUT in this question the person says the boyfriend confirmed that she COULD keep it. Once he said that, it is a gift and he cannot normally then change his mind---she can argue.

In this regard you are the owner of the rings and chain and he could not demand it from you at this point of time.

She can argue but can she prove that the conversation took place if he denies saying that?

Of course he can - he can demand anything he wants to.
