Default I gave my business tenant an OK to use part of the basement

New York

I gave my business tenant an OK to use part of the basement free of charge.
Now I need the space and want to tell him to remove all his possessions.
Do I need to send him an eviction notice? Do I need to go to court?
What is the quickest I will be able to evict him from the basement? (only)
Thank you for your help

You can sent a notice to the tenant providing reasonable time to vacate the space occupied. If he is not willing to vacate you an approach the law enforcement to evict him.

I wish to inform you that the status of the tenant with regard to the basement is that of a tenant who does not pay rent. You may first serve a three day notice to vacate the basement on the tenant . If the premises is not vacated then you may serve an eviction notice on the tenant. Further, you may contact an attorney and seek guidance.

Of course if he has no lease you should just explain the legal status and ask him to leave firstly.
