    Marriage to a married woman

    In Texas what happens if I marry somebody that is not divorced.
    She said she was divorced but in fact the divorce never went through -- that divorce was supposed to be final six years ago.

    It's bigamy, that's a crime.

    You can get the marriage annulled. I suggest you do it quickly and get this woman out of your life.

      There is an odd TX law that once the divorce becomes final, your marriage would spring into validity. Check that out too.

          IN TX a marriage that is void due to bigamy may become valid when the prior marriage is dissolved if, after the date of the dissolution, the parties have lived together as husband and wife and represented themselves to others as being married.

            If you marry a married woman who is not divorced, your marriage with that woman will not be considered as valid marriage. In the eyes of law the first marriage which is in existence is the valid marriage. So both the spouses will not have rights and responsibilities in the second marriage.

              The second marriage is voidable even after the first has been legally terminated. Particularly if the other party was unaware their spouse was still married to another at the time of their nuptials, among other things.
