Default Dunia Finance Credit Card, Advice Needed.

Hi
I have a credit card from Dunia Finance.
For the past 5 years, I've been paying them a minimum due of 1600 AED every month.
My credit limit was 30,000.. I had used 21,000. I have paid them over 100K in all these years if I am correct.
About an year and a half ago, I was late in my payments, they deposited my security cheque with an amount of 42K and got it bounced, but never filed any legal case.

I have about a month's due payment now and I am already receiving threats for legal action and police case.

My questions are:

1. Can they take me to jail over this cheque which was bounced 1.5 year ago? Whats the legal status of the cheque? still valid?

2. In case Dunia Finance takes a legal action against me, will it involve jail time?

3. What's the worst case scenario if I don't pay/delay the payments?

4. What will happen if they file a civil case?

I wish to inform you that in case of cheque bounce there has been recently amendment in the law under Law No. (1) of 2017 whereby fines may be issued in case of cheque bounce if amount of dispute is below AED 200,000. If you had made good the loss caused because of breach of contract then you may argue that payment due under cheque bounce has been made by you or an agreement in this regard had been arrived and payment under such agreement were being paid from last one and half year. In case of civil case there may not be jail or imprisonment but recovery of amount due from you. Criminal cases are cases where there may be fines, penalty or jail term.

I didnt get this AFFA.
A security cheque which has been bounced 1.5 years ago still is a valid cheque to file a civil case? how long is the validity of a bounced cheque?

I didnt get this AFFA.
A security cheque which has been bounced 1.5 years ago still is a valid cheque to file a civil case? how long is the validity of a bounced cheque?

1. A cheque bounce has a validity of 180 days to file a case and banks do not file case if they bounce that in your personal or salary account. When you apply for a liability from any bank, they simultaneously open a dummy account on your name within and bounce cheque copy as has their own regulations inside the same bank which you avail a loan or card.

2. It depends on what you answer the prosecutor who questions you and to the judge. Also depends on the Emirate you have case in, questions differ and you have to answer appropriately.

3. Worst case scenario would be that you end up having a cheque dishonor case and then pay fine to the court if that is the judgement imposed on you. If jail term then serve the jail sentence. It all depends on what you answer the prosecutor and judge.

4. They do not file a civil case for such amounts mentioned above.

Thank you for your answer. I appreciate it. Just little more advise please.

Firstly, I am in Abu Dhabi.

Secondly, the cheque which I had given to Dunia Finance was given as a security cheque which belonged to Dubai Islamic Bank. I had account in DIB at that time and its closed now. Cheque didn't have any amount or date, just a signature as Dunia Finance asked me. i delayed 2 months payment and they presented the cheque at DIB.
As I mentioned, its been 1.5 years since Dunia Finance presented that cheque in DIB with an absurd amount of 40K+ and got it bounced.
I'm tired of paying 1700 minimum every month to Dunia Finance, they aren't offering a settlement plan even.

1. If I stop paying them the minimum due, Can DF use the bounced and expired cheque to file a case against me? Will they take the cheque to police or to the court?
(I have seen people handcuffed in cheque cases especially from DF)

2. If instead of paying them the minimum due, I keep on feeding them bits and pieces, will it be helpful? or is it my best interests that they file a cheque dishonor case and I could pay a sum of fine and get it all cleared?

I live in abu dhabi...I have a similar issue...
I am holding 3 credit cards, a personal loan and an overdraft as follows :-
1. Dunia Finance Credit Card of Dhs.102k (now increased to Dhs. 113k/-)
2. ADCB Credit Card of Dhs. 50k (now increased to Dhs. 60k/-)
3. Samba Credit Card of Dhs. 25k.
4. CBI Bank Personal Loan(Dhs.166,000/- and Overdraft (Dhs. 14,641/-)
All Amounting to ~Dhs. 380,000/-

The Issue is:-
*I had taken this Dunia Finance Credit Card of Dhs.90k then they increased my card limit to Dhs. 102,000 and since that time I have been paying them emi every month regularly to the extent

that I recently paid them a massive amount of Dhs. 50k then again used my card again. But now due to a severe financial crisis I was not able to pay the min. payments for the past 3 months.

Now after 3 months of them calling me every single day harassing for money they have sent me a legal notice with a whopping amount of Dhs. 113,000/- and they have threatened me that

they deposit my security check in bank (which belongs to the old bank account, that is closed already) then they will file a police case and put travel ban on me.
*Same issue with ADCB Credit Card, Could not make minimum payments since past 3 months and now they too threaten to file a case if not made a complete settlement of Dhs. 60k or minimum payment of Dhs. 22k.
*Now I am not able to even pay for Samba Credit Card minimum payment.(~ >Dhs. 1000/-)

My Situation is :-
My Salary is Dhs. 12,650/- from that half of it is taken by the CBI bank for loan installment of amount Dhs. 6k and rest goes for house rent, kids school fees and misc. expenses. Leaving no amount to pay for the credit cards.

My Problem is:-
1. Threatening by banks to file a case and put a travel ban on me.
2. I have no money to pay them any longer.
3. I don't have anyone who can financially help me to settle these outstanding and close these horrifying credit cards once and for all.
4. I cannot even apply for a top up loan from my own CBI Bank due to high DBR.
5. I also asked each bank for help but they declined to do so, else give illogical settlement plans like Dunia Finance told me to consolidate my credit card into a monthly payment of Dhs. 4500/- for next 8 years (which sums up to 4 times the amount I took)

Please provide me with a permanent solution to come out of this debt mess ASAP.

There is only one solution for the issues you have and which will ease your situation legally. As you have already mentioned, no banks will consolidate your liabilities, give you top ups as the ECB being in place and never with a good settlement plan. Do not evem try to do anything as such as it would only be waste of your time. We would let you know what exactly you have to do and how, just email us to contact@uaedebtsolutions.com
