NY

Is a health care power of attorney different than an overall POA?

If I already have an overall POA from my father - does that include all health care issues. The POA says to assist "on any and all health care issues"--it's just one sentence.

A health care POA will give authorization specifically to health care matters but an overall POA gives wide authorization. In your case the overall POA gives wide authorization including health care issues.

I wish to inform you that the New York Health Care Proxy Law will have jurisdiction in this matter. The New York Health Care Proxy Form may be executed by a person along with two adult witnesses. The form is provided by the NYS Department of Health and is available in English, Chinese, Haitian Creole, Italian, Korean, Russian and Spanish. An attorney may be contacted for further guidance in the matter.

Most lawyers these days have clients execute a DPOA AND a health POA or patient advocate document.

One sentence in the DPOA is not enough to cover the range of normal issues. So the thinking goes.
