Default The judge in my divorce case slept with my wife 25

The judge in my divorce case slept with my wife 25 years ago in high school.
Is that a reason to force him to recuse himself?
He has not voluntarily resigned from the case.

I wish to inform you that the laws of your State will have jurisdiction in this matter. You may file a Motion for Recusal for the Judge on grounds of violation of the ethical cannons. The burden to prove your allegations in the Court will be on you. You may contact an attorney and seek guidance.

You can't "force" him to, you can ask him to.

If he says no, you'll have to go through the divorce process and then appeal any decision he makes if you feel it was made out of bias.

No I do not. Mostly because my wife and I don't really have any assets, and we have limited debt, so it seemed like a 50/50 split on a little debt on that's it. She has an attorney but he isn't doing too much.

But still I don't like the idea of the judge being in that position given the history.

Given that your divorce appears simple and uncontested, the judge won't have much to do beside rubber stamp whatever you and your wife come up with. His history with your wife would seem to be irrelevant from any kind of legal standpoint though perhaps not from an emotional one which is irrational but understandable.

I would think most judges would not remain on the case under the circumstances.
