In Florida can a doctor practice medicine legally without malpractice insurance?

Thank you!

Basically, no. But there are alternatives allowed and there are some exceptions.

Read Florida statute 458.320 Financial Responsibility:

If the doctor has no malpractice insurance do victims just sue the doctor in his own name then? What if he has no money?

Does New York require medical malpractice insurance?

I am considering a claim to file.

You have no one else to sue BUT the doctor "in his own name".

Based on your apparent lack of knowledge, I suggest you consult with a licensed NY attorney.
