As-Is means As-Is. Your failure to have the vehicle properly inspected and issues diagnosed, does not create a liability on the former owner. Further, you have no proof the issue did not occur due to your own negligence after purchase.

AS is, can hardly be more clear.
Don't buy anything AS IS if you don't want to accept the risk, or can't get it inspected, in the case of a car.

That would be a tough case unless the judge really dislikes the alleged lies or conduct of the seller.
When you buy "as is", you need to get an inspection.

You can always try but "as is" is a pretty solid term in contract law--though it does not excuse outright fraud if that fraud somehow caused you to buy as well.

Even if the sale is "as is", could I successfully sue in small claims court if I have emails that show the seller was purposely lying about the engine, that in fact he had taken it in for repair and they told him it was close to shot.

I agree, if the buyer would do that fine, but no buyer is normally going to do that.

It's a lot of risk to assume.

Get the mechanic to do a check!! That's the way these things are done.

In a very complicated manner, yes. that said I do not know of a seller dumb enough to rely on a buyer to maintain the vehicle.

Is having the seller make a written guarantee, that it will operate without repair for at least 90 days, binding and legally valid?

Nobody should buy a car "as is" unless a certified mechanic inspects the vehicle.

You are just begging for problems and trouble. And as noted above, legally there is not much you can do.
