Default Doctor paying 1000 dollars to not file claim?

Is it legal if my doctor offers me 1000 dollars not to file a malpractice claim?

Is that some kind of bribe or something? It seems fishy to me but I can't really explain why.
I mean it's not really a settlement, because nothing has even started yet?

It's legal. It really is a settlement negotiation, not a bribe.

If you accept it you'll be required to sign a release so you can't sue later.

Like any other settlement negotiation if you don't think $1000 is enough to compensate you for your injury or condition, you are free to ask for more. If the doctor balks you are free to file your lawsuit.

Negotiating a medical malpractice settlement without some type of formal legal action, though valid, is extremely rare. To win monetary compensation for injury related to medical negligence, a patient needs to prove that substandard medical care resulted in an injury. Compensation can be calculated by taking into account both actual economic loss such as lost income and cost of future medical care, as well as non-economic losses, such as pain and suffering.
