Default Taken to emergency while choking

I had a severe throat inflammation that my doctor misdiagnosed as allergies.

Two weeks later I was taken to emergency while choking, almost to death..

Do I have a case to sue and receive damages?

I wish to inform you that first of all you must collect all your medical records. Thereafter, you may get them reviewed by a lawyer and a doctor. To proceed with the case of medical malpractice you will need expert opinion from a doctor with the same specialization that a case of medical practice may exist in the particular situation. Finally, you may serve a notice and if the matter is not resolved then you may proceed with a lawsuit.

Like what? You recovered, didn't you?

At best, you might be entitled to getting your bills paid. But little else without a long term disability resulting from the error. And I doubt that any malpractice attorney will take something this small on a contingency.

Sorry, you haven't one the lawsuit lottery.

Start by writing to the doctor, explain the results of his error and demand that he reimburse you for your bills. If that doesn't get you anywhere you have the option of suing him in small claims court. Otherwise you'll be paying a lawyer a lot of money for nothing.

I doubt there is a case here. Not every diagnosis is 100% correct the very first time.
It often takes a few visits if the issue is something unusual, so that standard options can be ruled out. You would have to show the doctor was negligent in his duties which does not happen too often these days, sometimes, but not often,

But you can always take the file to a few med mal lawyers and see what they have to say.
No harm in letting them have a look, if they will.

You can file a medical malpractice case against the doctor if you have all the records of the treatment.
