    Can you sue for slip and fall if you just sprained your ankle?

    Can you successfully sue for slip and fall if you just sprained your ankle?

    Or does the injury need to be larger?

    If you are injured due to the negligence of another you are entitled to compensation regardless of how minor the injury is.

    Understand the following:

    1 - The less serious the injury the less money you get.

    2 - Just because it happened on somebody's property doesn't mean that somebody else is negligent in causing your accident. You might just be a klutz.

    3 - If there was negligence involved you might not even need to sue, or even get a lawyer, to get some money for a minor injury.

    Now, explain what happened to you if you want some helpful comments.

      Thanks very much!

      I was leaving Home Depot and carrying 3 pieces of lumber. To my car.

      There was a 5 to 8 inch hole in the payment and I stepped in it and fell.
      And with the wood and all, down I went.

        You can sue the owner of the property, if you can prove that the cause of the accident was due to the dangerous condition in that property and the owner of the property is aware of that dangerous condition, but had not taken care of it to avoid danger to persons entering the place.

          Lexus is correct as far as it goes but it's not that simple.

          What was the date that this happened?
          Did you report it to the store manager when it happened?
          Did you take photos of the defect?
          Any witnesses?
          Is the defect in a remote part of the parking lot or close to the store entrance?
          Did you have any medical treatment?
          Did you lose any time from work for which you didn't get paid?

          The bigger issue is whether store management knew, or should have known, about the defect.

          Answer all of the above when you come back and we can discuss whether it's worth pursuing.

            Can you not work?
            Are you paying large medical costs?
            You don' have insurance either?

            Usually a sprain is not the kind of thing you sue over.
            At least in my neck of the woods.

                The question "Can I sue" always means "Can I sue and win."

                I decided that after writing a hundred times that "can" denotes the ability to do something, not whether it's right or wrong or successful.

                It was fun the first 99 times and then got tedious.
