Can I refuse to participate in a class action regarding a medical device and try to sue or negotiate some larger settlement (myself or with my own counsel) than I will get in the class action?

Yes, you are not obligated to join the class action. You can sue on your own.
Just understand that, if there is already a class action in progress it means that the issue is complicated and you'd be in way over your head if you attempted to litigate without a lawyer. |
