Unhappy CC Debt, Collection Agency Threats, Harassment -- HELP

Hi there, ok I have a cc that I defaulted on, I couldnt make the payments, I couldnt keep up. Its been around a year since I have made payments and I was contacted by an agency early in the morning, that told be basically I would be going to court/jail, if I did not set up arrangements to pay the 2000 balance immediately. Now I have never ever been in any kind of trouble before, and I was in tears with confusion, I gave them my checking account info with LARGE payments sums set to come out that I knew I didnt have yet, but was going to do everything I could to get.

Later on I had realized what I did and told some people, because I was worried about just giving out my information over the phone, I called the company that the card was thru and they told me they did not contact me ( I didnt realize they werent one in the same). So fearing fraud I contacted my back to have the checking accounts closed. (the bank ended up actually putting a hold on it instead of closing it which I discovered after the fact) So I called my cc company back to set up payment arrangements, I was bounced around until they discovered outside agency had me, after getting contact info, I contacted that agency.

I told them that my checking acc was closed because I thought it was fraud (which I thought was true) but I wanted to make separate weekly payment arrangements, because I couldnt get the money I had hoped I could. They told me no, and I would be prosecuted for felonious default. I am a waitress, the only payments they would agree on is the 2000 within a month span,1000, 500, and 500. On check, I make between 60-80 a week, and 70-100 in tips each week. I dont own a car, I lease. I dont own a home, in fact I dont really own anything except a cheap tv and some clothes. I feel really taken advantage of from this agency, like I was badgered into giving my information...obviously because looking back the way it happened I thought it was fraud. But bottom line, what is going to happen to me, can I get some help? Like I said ive never been in trouble before for anything...I want to get this resolved, but just looking for some advice as to how I should handle it. Thank You very much

also..i lease a vehicle will that be taken..i dont own it been in the lease 1 year now

Don't pay a penny. They can't collect what you don't have. Idle threats mean nothing. Ignore them. If they continue to call contact your local District Attorney or the Attorney General of your state

It is illegal to threaten you with imprisonment, to coerce you into giving bank information and to harass you. I am reading Debt Cures by Kevin Trudeau and he explains everything. I really recommend this book to anyone who wants to be free of debt. You have rights and also they can not get what you don't have. If this is a collection agency that means that your original debt was claimed as uncollectible and the company was compensated for that debt. They sold this debt to a collection company for pennies on the dollar and are now trying to strong hold you into paying them for a debt that you don't owe them. Remember that debt was already settled with the original creditor (they were compensated for it).

If you write them a letter stating that you own nothing-That you are leasing a car and renting an apartment and have no assets that might be enough to stop them from coming after you.

NEVER agree to a debt make them prove it. Since you didn't know and you already agreed to it you should probably seek legal help. Google free legal advice for you area and a list of non profit lawyers should pop up.

Good Luck and don't lose sleep because of this.

Here's how to handle these unscrupulous debt collectors:

Send them a certified letter, return receipt (so they will have to sign for it)

Address the letter to the CEO, GENERAL MANAGER AND STAFF.

IN THE BODY OF YOUR LETTER, advise them that you dispute this ALLEGED DEBT, AND THAT THEY ARE TO IMMEDIATELY CEASE AND DESIST from further communication with you under penalty of law, until such time as they have COMPLETELY AND ACCURATELY VALIDATED THIS DEBT IN IT'S ENTIRETY, and under PENALTY OF PERJURY in accordance with the:

FAIR DEBT COLLECTION PRACTICES ACT

US CODE TITLE 15

TRUTH IN LENDING ACT

FAIR CREDIT REPORTING ACT

Also advise them that if they continue to HARASS you that you intend to MOVE FORWARD with complaints to the

DISTRICT ATTORNEY'S OFFICE IN YOUR STATE well as the STATE IN WHICH THEY ARE LOCATED

STATE DEPARTMENT OF CONSUMER AFFAIRS your state and theirs

BETTER BUSINESS BUREAU in both states..yours and theirs

Also, advise them, that you intend to file complaints with the BAR ASSOCIATION in your STATE AS WELL AS THEIRS under " THE ATTORNEY ACCOUNTABILITY ACT OF 1995"

Also that you intend to inquire with the FEDERAL TRADE COMMISSION in both states as well as Washington , DC ABOUT THE POSSIBILITY OF FILING FOR A
CLASS ACTION LAWSUIT AGAINST THEM, holding their COMPANY, OFFICERS AND STAFF personally and corporately liable.

FURTHER ADVISE THEM THAT YOU INTEND TO CONTACT your CONGRESSMAN IN WASHINGTON , DC and ask them to assist you by expediting your complaint with the US DEPARTMENT OF JUSTICE as well THE FEDERAL TRADE COMMISSION in WASHINGTON.

Also, in as much as you question their legitimacy, and since the letters you have received from them appear to be deceptive and misrepresent the facts, and in as much as the letters have been sent by US MAIL AND CROSSED STATE LINES in TRANSIT, that you will file complaints with the US POSTAL SERVICE complaints and FRAUD DEPARTMENT,and that you will inquire also with FEDERAL BUREAU OF INVESTIGATION requesting they investigate this matter as well, in alleged violation INTERSTATE and INTRASTATE COMMERCE LAWS.

Close your letter by stating:

EITHER 'CEASE AND DESIST" FROM FURTHER COMMUNICATION AND COLLECTION ACTIVITY" or you will move forward with the above.

I remain respectfully yours,

(your name and address)

NOTE: GOOGLE " FAIR DEBT COLLECTION PRACTICES ACT" AND ALSO USCODE TITLE 15, and you will probably find that the COLLECTOR has violated ONE OR MORE OF THE ARTICLES IN EACH. BE SURE TO ADDRESS EACH OF THE VIOLATIONS YOU FIND in your letter.

ALSO GOOGLE "ATTORNEY ACCOUNTABILITY ACT OF 1995" FOR INFORMATION PURPOSES.


Use this letter and exisitng law to SLAM THESE COLLECTORS . make them aware that you know your rights !!

Not sure what a CC debt is.
I'm in the US and having terrible problem with my Guaranty Agency threatening me. I'm broke currently and they are demanding huge payments.
What can I do?

can i got to jail for unpayed payday loan they called and said if i cant pay them they are going to take legal action does anyone what kind of of legal they are talking about i cant pay the amount by the time they said so im going to jail
please help nme

After 46 years in the Postal Service, I have always heard people request a return receipt because that is what the lawyer said to do.

ONE, all certified mail is signed for, with or without a Return Receipt! The record of delivery is now stored in the Postal Services computer system and all you have to do is look it up and print the information on the screen.

Certified Mail $2.80 $2.80
Restricted Delivery $4.50
Return Receipt $2.30 2.30

Your Total (includes First-Class Mail Letter for $0.44) $5.54

Since you can get the information online,you can save that $2.30!

If your having a lot of problems, that can add up, ten letters becomes $23.00!
