    Sale of land with shed in Texas

    Does an agreement to sell a plot of land with a shed on it, in Texas, have to be in writing?

    We made the deal 4 months ago and now the seller is backing out with no real reason.

    The shed is irrelevant.

    Contracts for real estate must be in writing to be enforceable per Texas statute Business & Commerce Code sections 26.01 and 26.02(b).

    There is an exception when partial performance has been made, but it's limited.

      An agreement to sell land should be in writing to get legal sanctity. It is difficult to prove a verbal agreement for sale of land before a court of law.

        I guess that is true also for a deeded parking space for sale in Houston right?

          Yes.

          Whatever comes with your property should be specified on your deed.

          If you think you have a deeded parking space you'd better read your deed and make sure.

          If the parking spaces aren't listed on your deed then you don't own them.
