Default Bicycle hits car door when opening door

NY

Who is legally responsible or liable if I open my car door while getting out of my car on a city street and a bicycle rider hits my door--runs right into it? I was validly parked and getting out of my car at the time.

I did not see the bicycle coming but is it my fault, why should the bike be in that location at all?

I wish to inform you that it is stated in NYCRR- Section 4-12-(c) Getting Out of Vehicle: In New York City: "No person shall get out of any vehicle from the side facing on the traveled part of the street in such manner as to interfere with the right of the operator of an approaching vehicle or a bicycle." The "door zone" is the space of 2-4 feet adjacent to parallel parked, double parked, or stopped cars. You may contact an attorney and seek guidance.

Yes, it's your fault even without that statute.

You didn't see the bike coming because you didn't look. That's negligence. Could have just as easily been a car.

NYC is teeming with bike riders.

But we don't know that this happened in NYC. Bleklan refers only to "a city street" and my comment was based on negligence law, not location. Could have happened anywhere in NY State (or anywhere else) and Bleklan would still have been at fault.

Assuming NYC was a blunder.

That was certainly the image though that popped into my mind.

I didn't see that happening in some lovely tranquil rural area.
