If you think the issue is a manufacturing defect, you can approach the Federal Trade Commission's Bureau of Consumer Protection. They stop unfair, deceptive and fraudulent business practices by collecting complaints and conducting investigations, suing companies and people that break the law.

Any problems should be reported to the consumer agency in your state or country, and to Mercedes Benz customer service who have an excellent reputation, as of this date.

The dealer tells me the manufacturer is the one holding up any replacement.

Yes the dealer does decide if it is justified or not, unless the issue is manufacturing defect recognized by the manufacturing company and scheduled to be repaired--such as in a recall.

But perhaps you mean the part is not available? Dealer can't fix that.

I have not seen any forums or articles showing BMW has a similar issue.
