I think in this situation you can just have your rent back for the interval of treatment... like for the days you will leave your home you dont need to pay your rent.....

Yes, as other posters mentioned, the tenants gets a pro-rated rent for the days the tenant is displaced. That's it. Nothing else, in CA anyway!

This is all wrong on part of landlords. My argument against landlords and the reason I think ( and I think a court case against landlords would work ) is that the landlord is responsable for the building condition. An infestation that requires tenting is not something that happens over night or in a couple months. This shows years of neglect and culpable negligence. A landlord that fails to yearly maintain a building against termites or one that has hired a bad pest control company that did not do its job is responsablefor the expenses that his lack of maintenance causes.

Moving for 4 days,paying for a hotel andmeals, this is something that added to the hours of preparation, loss of plants and other items, is not something that can be paid with $35 dollar a day vouchers.

The lack of maintenance caused this issue that had to be dealt with tenting. The landlord is responsable. Had this been an infestation as a resultof an act of God, that would be different.

How can a landlord defend himself against this argument of neglect? If he treated the building on a yearly or bi yearly basis, no infestation would had needed tenting. Only no treatment can cause it ( or a bad pest company in which case the landlord has to sue that bad pest company that robbed him.) The tenants have nothing to do with this lackof maintenance.

Termites happen. They are often in places where no one checks, like in the attic rafters. There is seldom evidence of an initial infestation. Landlords don't control termites and where they land to nest. No landlord wants the damages caused by termites. It has nothing to do with lack of maintenance or neglect, you fool.

Landlords are not responsible for an annual inspection of rafters, foundation, etc. Many landlords do not even DO an annual inspection.

Your lack of knowledge is showing. You can rant and whine all you want. Take it up with the State of California and their laws regarding termites and tenting.

You, as a tenant, choosing to live in a wood frame building, are probably responsible for the termite infestation because, after all, you choose to live there. Or perhaps you have yummy wooden furniture, that is just sooooo delicious to termites! Yes, you have set up the conditions for pests to come to you!

If you don't like it, leave after your lease is up. You are caterwauling like a 2 yr old's temper tantrum. Grow up.

Your bias and favoritism toward the lndlord side is evident. Your boorishness in writtng aand your rude demeanor shows disrespet and childlike responses.

It is writ you have no knowledge of the responsabilities a landlord has . You sound likean idiot.

California Tenant Law - Free legal advice for California renters' rights

It would be better to look at the actual law than a bunch of landlords who have a vested interest in keeping as much money as they can.

The thing is termites can be prevented. The tenants and Landlords should cooperate.
