Default Displaced- termite fumigation -- Tenant rights in CA?

Our Landlord will be tenting the house we rent because of an active termite infestation. This is supposed to be scheduled for the end of next month.

What are our tenant rights by California law or California code?

Do we get our rent pro-rated for the time we are not able to stay in the house?

Is the landlord legally responsible to pay for putting us up in a motel?

Is the landlord legally responsible to pay for our meals at a per diem rate?

Is the landlord legally responsible to pay for any inconvenience?

You can deduct the pro rata rent for days you are forced out.

He does not have to pay hotel etc.

The landlady is not responsible for your expenses at all. But in case you can deduct your pro-rated rent.

I'm a LL in CA and had to do this very same thing for an active termite infestation earlier this year.

Your rights as a tenant in CA is only this: You get your rent pro-rated. Period.

You have NO rights to per diem meals.
You have NO rights to get paid for your inconvenience.
In fact, if you are on a month to month rental agreement, your LL could have terminated your tenancy, waited until you moved out, and then tented the place.

My tenants are wonderful and have been there for over 8 years. They keep the place clean and neat and have never been late with the rent. Because of this (and believe me, not all tenants would get this treatment from me), I notified them in writing that I would pay for the cost of one night at a motel up to a limit of $35. When you go on Orbitz or Travelocity, you can get deals as low as $25/night. They had this option, or the option of my prorating the rent--it was their choice because I keep my rent so low that the pro-rated daily rent would not have covered the cost of a motel for everyone.

I required a receipt for reimbursement of the motel stay, and stated I would only pay for the stay, not any pay-per-view movies, etc.

I also gave them a food stipend of $20 for each person to cover two meals a day--one can buy a lot of food, including salads and fruit, at out local fast food places. Often, the motels will have a continental breakfast.

It's nice to make the temporary displacement as easy as possible for good tenants, who are worth their weight in gold!

NOT all tenants are like this. NOT all CA landlords would do this.

Not all Landlords would do this. Well give you self a big pat on the back! If you truely belive good Tenants were worth there weigh in gold you would be so cheap. Period.
