Default Property transfer issues in Mexico as an American citizen

I have had a condominium fully paid for in Puerto Vallarta for the last 20 years. I'm attempting to update the transferring of property to my son as beneficiary instead of my brother. I've had a lawyer 'working' on it for the last year and a half. He keeps telling me it's ready next week, next week. It's been ready next week for a year. Now he is dodging my calls. My problem is- I've been told that in instance of property transference and inheritance I must use the government appointed lawyer, so I have no rights here or any ability to switch lawyers. Is this true, and is there anything I can do?

I don't think your stuck with just one attorney in Mexico.
My sister in law faced a similar situation and easily change her lawyer.
But there are many ways to hold property in Mexico as you know so it is hard to give one clear answer.

I would suggest you call a couple new attorneys and talk about hiring them to finish up the matter. See if they identify any roadblocks. Most will talk to you for free for a little while to see if they indeed can handle the matter for you.

I wish to inform you that the Office of American Citizens Services, U.S. Embassy, Mexico City maintains a list of attorneys which is available online and may be accessed by you. You may then contact the attorneys listed therein and seek guidance.

Also if the lawyer simply will not respond or continues to delay, consider filing a complaint against the lawyer with the lawyer's licensing authority or whatever Bar or Law Society licenses lawyers there.

That works wonders in many cases.

In this case if you expended some amount as attorney fees and you are not receiving proper service from the attorney but only negligence, you can file a malpractice complaint against the attorney with the concerned bar to which the attorney is associated.
