Default DePuy’s Hip Replacement: The New Big Thing in Product Liability Suits?

Litigation is lining up against DePuy, a unit of Johnson & Johnson, over faulty hip replacements.



A story over at Brand X today discusses a troubling loophole that exists in the Food and Drug Administration’s regulation of implants.

Unlike new drugs that must go through clinical trials before getting FDA approval, some implants can be sold without the tests if it resembles an implant already in use, the story says.

According to the suit, DePuy received notice of several hundred complaints made to the FDA in 2007-08 but didn’t issue a recall until late August 2010. The suit says DePuy has offered doctors $50 for obtaining the patients consent to receive his or her medical records and is asking doctors to send any devices that have been removed.

Doesn’t it make us anxious about this issue? The company is so negligent on their part to bring the patients to dilemma they don’t deserve. They shall be castigated and reprimanded. Lawyers are to share their knowledge to the concerned.

The origin of the subject matter is the faulty product employed in hip treatment undertaken by the affected patients. These out of order devices triggered them so much difficulty that they be subjected to too much pain. This can be disallowed from occurring once more in the forthcoming by inquiring for the assistance suggested by the professional lawyers.

Everybody is unhappy on what had happened to the patients who undergone the hip replacement surgery using the defective device. Think of how much pain they have to suffer after that. The company deserves to be punished. Lawyers can help the affected people.

For patients who have undertaken hip substitution, it is really outrageous that some of the major names in the orthopedic industry broadcasted their pulling out from the individual hip. This recall engages more than 90,000 units broken products, leave-taking people speculating and doubting if they finished up one of these faulty products.

Default what is your view against hip recall?

There are many reports about the faulty hip implants made by DePuy, a subsidiary of Johnson and Johnson. Do you have any experience or insights against this topic?

Many of them experience extremely damage because of this device.

The greatest problem with this recall is that we are not talking about a cough pill, on the label of which are not shown all the components correctly. These hip replacement systems, more then 90000 of them, has been surgically implanted in patients. Imagine what these patients felt when they heard about the recalls. It is totally appropriate for these victims to look for legal help.

Lots of people has been greatly affected and struggling with this dilemma. Instead of having medication many we're injured. Depuy hip replacement doesn't always give a good impact to human being.

The route you're referring to is the 510(k), or "fast track" route. It's supposed to be meant for low risk devices but manufacturers are now using it to improve something as invasive as a hip implant. Now thousands of people have an untested device inside their bodies...are we supposed to be surprised there are so many lawsuits?
