Default Law re emotional support dog on a leash

Yes, I find a letter in my mailbox 2 day that my landlord is taking me to court for breaking one of the lease rules which was to have my emotional support dog on a leash. We have been in this apartment for 8 months now and cant get the landlord to fix any of the things that are wrong with the apartment.

Can the LL evict me for this? It seems petty to me.

You can be evicted for breaking the terms of your lease. It doesn't matter what it is or how petty you believe it to be.

If she wants to evict you, the judge will likely not do that solely for that alleged violation IMO--but indeed he may order you to keep the dog on a leash when on the LL's property.

It doesn't matter where "OP" lives.
...few judges are going to evict somebody from their home because the dog was off the leash a couple of times. Just aint gonna happen. (if that is all that happened)

I have been at the courts hundreds of times and seen cases like this many times.

A Pattern of Lesser Violations Can Lead to Eviction

Aside from not paying rent, there are other actions that constitute lease violations, and while some are not serious enough to result in eviction, a PATTERN of lesser violations can result in frustrating a landlord to the point they consider eviction, such as:

keeping a pet in a no-pet property,
repeated neighbor complaints for noise, or
not properly maintaining the property.
