    Non-US NPO

    We are a European nonprofit healthcare society. We are interested to organize training courses for doctors and scientist in USA at multiple locations.

    We would appreciate if you can guide us about these questions:

    1) As being non US based NPO, do we need any kind of special permission/license or permit to for organizing such training courses in USA ?

    2) Do we need to declare income as a result of course fees registrations and would we need to fill some income tax documents prior/after the course?

    3) The instructor/speakers need B1/B2 visa and that would be enough to deliver the course or he/she would need any other specific visa to deliver the course? he will receive travel/accommodation reimbursements from the organization but no honorarium for the course.

    I wish to inform you that if you are organizing your events in USA and collecting fees from USA then you may be subject to US tax authorities including IRS for income from events. As you are not registered as non profit in USA thus you may be liable for tax in USA for income arising in USA. You maybe required to registered with the state authority where you intend to carry your business. You may also register with IRS as non profit body and seek exemption from tax liability.

      What is the difference between a "nonprofit" and a "not-for-profit" organization?
      Does it depend on any STATE law designation?

        There is no difference as that term applies to organizations.
        It is used interchangeably in the industry.

          For the original OP, you will need proper Visas to establish this with foreign workers. To Jenny, there are usually two basic types of non profits. One has state non profit status, the other obtains both state and Federal non profit status for tax purposes.
          Due to a recent promotion, I should now be referred to as Major Obvious.

          I would not be trying to provide information and knowledge if I did not sympathize.

          Some days it is just not worth chewing through the restraints to face life.
