Deadlines by which insurer must pay you?

Is there a legal period in New York by which the insurer must pay you for the damages of your auto accident?

Or can they just delay it as long as they feel, or as long as they say they are still working on the claim?

Is this a claim against your own policy or against the other driver's policy?

Either way, what was the date of the accident and how did it happen?

Any issue regarding fault?

Against my own policy.
I hit the driver in front.
It has been almost 60 days.
I turned in the claim and they said ok, and I am still waiting.

Do you have Collision Coverage?

Is this a claim for the repairs to your own car?

If yes to both questions, the deadlines for claim settlement are addressed in the following regulations from the NYS Department of Financial Services:

Yes and yes.

I have just turned in the claim and been waiting so far.
I called them once and they said they would call back but did not do so.

Keep calling.
Call the claims department manager.
File a complaint with the state insurance department.

No reason that a collision claim should take more than a week or two.

Excellent ok, I will be in touch with them daily.
I thought that something seemed not right but really wasn' sure of my right to complain or not.

File suit in small claims court if they keep giving you the runaround, that will get their attention.

It sounds a bit unusual to be honest, I would pursue the customer service angle diligently and see what really is the problem. Most insurance companies are not going to try to purposely cause some problems where it does not exist.
But if they do, you can file a complaint with the state attorney general and the insurance ombudsman if one exists in your state. The AG's office can also direct you to the most efficient problem solver with insurers.

The New York State Attorney General does not deal with insurance issues and there is no "ombudsman".

The OP needs to deal with the state insurance department, which he was already advised of by Jack.

The AG (as noted on their site) specifically has a division that directs people to the right office in hundreds of regulatory areas.
Just FYI.
So when in doubt that indeed is a good place to start.
Also sometimes people think it is one area but it is actually another.
EG health care insurance is not handled by the insurance complaint system.

I have found that putting 3 or 4 calls into them will almost always resolve the issue although with state farm I can sometimes be bounced around and on-hold for a good hour or so. Especially their pension and retirement dept.
