Default How can I prove a firm really filed for bankruptcy.

How can I prove a firm really filed for bankruptcy.

I am trying to collect on a 2500 dollar receivable but they say they filed for BK and it's illegal for me to now try to collect BUT they refuse to show me any paper that proves it is filed and I have nothing in the mail either?

I wish to inform you that you may check from court records. In this you may seek case number from party and then you may check from court record details of bankruptcy and further your name should be in creditors list in order to obtain amount due from court. List of creditors is filed with court so that total amount due may be known and action for recovery of their amount may be taken.

If they can't tell you which court it is in, they are lying almost surely, so go ahead and collect if that's the case.

Look them up on PACER. PACER is the federal court search feature. Includes bankruptcy cases.

I followed that suggestion and called their bluff!
They admitted it is NOT filed. So I can and am collecting.

As there is no formal publication of bankruptcy order you can go ahead with the collection procedures. It is their liability to prove that they filed bankruptcy.

Seems like it should be bankruptcy fraud or somehow illegal to tell people they filed and then they really didn't. That is really an abuse of the protections that bankruptcy law provides when truly needed.

The US prison system isn't big enough to hold everybody that lies to creditors.

Not a bad idea perhaps. Misusing the power of bankruptcy creates a lot of hassle for a lot people.

The laws ARE strict if you are a party actually in bankruptcy. Any fraud or dishonesty there will land you in jail.
